3G iPhone complainant sues Apple Inc. for dropped calls

Recently, a female 3G iPhone user from Alabama took her complains to the next level. She filed a lawsuit against Apple Inc. The lawsuit claimed that the drop calls from the second-generation iPhone. It also stated that she had troubles connecting to the network of AT&T and the service is slower than what they have advertised.

Furthermore, the lawsuit is also looking for a class-action status. This information was taken from the papers that were filed in the federal court. The complainant called the Apple Inc. smartphone the “defective iPhone 3G” all throughout her lawsuit. The complainant from Birmingham, Jessica Smith, charged Apple Inc. with implied warranty and breach of express as well as unjust enrichment. The lawsuit claimed that the advertising blitz of Apple Inc. was actually misleading.

According to the lawsuit “Defendant intended for customers to believe its statements and representation about the Defective iPhone 3Gs, and to trust that the device was twice as fast at half the price.”

The phrase “twice as fast at half the price” is still being used by Apple Inc. in their marketing. Their official website has the same headline as well.

However, Apple is still not facing the press and giving comments about the lawsuit.

    Once again… “are you F’ing kidding me”? This woman needs to be slapped too! If you don’t like the phone, sell it on eBay and buy another one. The phone is much faster (I believe it and I don’t even have one, still have my 2G iPhone), AND IT IS HALF THE PRICE. There is sooooo much information on iPhones everywhere. If you don’t READ any of it before you buy something, then maybe you should blame yourself for being a moron.

    I am getting so tired of everyone wanting to sue Apple because they are making a lot of money for creating truly awesome products which are light-years ahead of most other products they compete with. If you don’t like it… DON’T BUY APPLE.

    Lawyer’s should be held accountable for even filing these frivolous lawsuits. They should risk being disbarred and/or even fined!!!

    I have the newest version (white 16gb 3g) and my girl has the previous generation that I bought her around christmas. Truthfully it definitely is speedier but I wouldn’t always wager that its twice as fast. The lady in alabama may be right about some things though, I have had numerous dropped calls (more than with any other phone I have used in the past few years on ATT network) and even though it is supposed to work on the 3g network most of the time when I look its saying that its functioning on the edge network. Maybe in certain areas…tell you what though, with both phones in my hand earlier today while out to lunch, the old one had 3-4 bars of service while I had no service on my new iphone. This was in a rather metropolitan area literally 20 feet from an interstate where there is always service. Dropped a call I was making about 4 times before I resorted to the old phone.

    All in all, I still love the hell out of it and wouldn’t jump on the lawsuit!
