An iPhone consumer from New Jersey recently sued Apple Inc., because of the dropped calls on the 3G iPhone. Moreover, the lawsuit also claimed that the device does not consistently connect to the data network of AT&T. this is the second lawsuit that was filed against Apple Inc. over the last two weeks.

The complainant, Eulardi Tanesco, gave the lawsuit to the U.S. District Court located in New Jersey. He accused Apple Inc. as well as AT&T of breaking the consumer anti-fraud law of the state. He also accused the two companies of violating the warranty, fraud statutes, as well as breach of contract. Just like the lawsuit that was filed by Jessica Smith of Alabama last August 19, Eulardi Tanesco also asked the U.S. District Court to grant the lawsuit a




class-action status.

In the lawsuit, it stated that Apple Inc. deceived the customers when they advertised and sold an alleged iPhone that was improved. Apple Inc. also gave a promise that the latest smartphone is an efficient and a reliable mobile phone.

Eulardi Tanesco said that he bought the 3G iPhone when the device had its debut last July 11. He said that he was never happy with the performance of the phone.

More often than not, Eulardi Tanesco and his second-generation iPhone can only connect to the EDGE data network from AT&T which is slower and older compared to the 3G network. But he did mention that he got a few moments that the smartphone can connect to the 3G network. However, it would shift to EDGE after a few minutes.
